Storm Tree Removal OKC

When a Neighbor's Tree Falls: Who Pays?

← Resources

General Oklahoma guidance — not legal advice.

This is general information, not legal advice. Your insurance policy and the specific facts control.

  • Healthy tree, storm damage: In most cases, if a healthy tree falls in a storm, each homeowner's own insurance covers damage to their own property, regardless of whose tree it was.
  • Dead or neglected tree: If the owner knew (or should have known) a tree was dead or dangerous and didn't act, they may be liable for damage it causes. Written notice to a neighbor about a hazardous tree can matter later.
  • Branches over the line: Oklahoma generally lets you trim branches that hang over your property, up to the property line, as long as you don't kill or seriously damage the tree.

Talk with your insurer early, keep photos, and consult an attorney for disputes.
